Il even has "Right to Defend" here, as long as your in the house, they dont have to be inside, but they have to be armed with something and have something that shows that they had Intent of breaking in.
So if they were on the deck i see they have a Gun or knife in one hand and a screwdriver or hammer in the other I'm allowed to Shoot first.
I'm just not allowed to shoot them outside if their breaking into my shed or garage unless they shoot at me first,then its a "Who's fault" call.

So you always make sure "its right"

If you shoot threw a door at someone as in the thread above in Il it is Legal as long as you can PROVE THEY MEANT TO HARM YOU OR YOU FEARED FOR YOUR LIFE.You have to be in the HOUSE.

You will be hearing here pretty soon in the papers about a Farmer from a small town from my area who is Charged with "Man Slaughter ".
His farm is just about on the IL/IN border and his farm had been broken into more than 4 times in 2 yrs and 1 time at gun point.
You get these Meth Heads who live on the border area that go up to
Pembroke Il/Hopksins Park area which is deep woods and alot of
"Illegal Shit" happens around there.
This couple ,one was a Guy on parole but had a Warrant out for jumping parole and 1st degree murder with a Meth head Mother of 3 from IN.
They came across and on the way to the "WOODS" as we call it they stopped at his farm to steal tools and whatever for drugs.
The farmer walked out of his house with a 12.gau Double barrell and caught them walking out of his shed.
The 2 dropped the stuff in their arms and hopped into Her truck, he hadnt drawn on them yet but the Guy opened up his door at the same time the Truck had its Reverse lights came on.
The Farmer thought the Guy was going to shoot him so he fired!
Because it "Starlted him" the Guy RAN OFF! the Woman slam the truck in reverse and he felt she was going to run him down so He fired again this time into the back of the cab.

She drove off got about 1/2 mile down the road before she crashed, and died from "00" buck shot in her back that came threw the cab.

The first shot from his gun had hit part of the tail gate and door when it was open.

So they at first charged him with "2nd Degree Murder" but the DA couldnt get a grand jury to indict on it but got the "Man Slaughter" charge so thats what the trail is based on.

Her Family KNEW WHAT SHE WAS DOING , because they wERE BABY SITTING HER KIDS"! They never tried to stop her, but are CRYING "HE KILLED OUR DAUGHTER"!
She had been using for few years, family never turned her in or took the kids.

So thats where the Law gets tricky, because he wasnt in his house, in conforted them outside ,and he shot her in the Back,.
So was she trying to GET AWAY? or "TRYING TO RUN HIM DOWN?

Our County is the 2nd largest in mass and if you call the Cops, to get there your wasting your time because theres never more than 3 deputies on duty.Too big of an area so what do you do?
The question is going to come down too"Do you have a right to DEFEND YOUR LAND knowing law enforcement isnt going to get there in time?

I'm barred from Jury duty since I know the DA and everyone in the Sheriffs dept.Plus I know the farmer's family

So I'll keep my "Thought" on Do I think he is Gulity or Not to myself for the time being.

But those who know me can pretty much figure it out.

Mentioned that "dragging them inside thing" cause I knew of a guy when I was in Jr High that had a problem with that sort of thing.
Early 70's a guy 3 blocks from us shot a guy through his picture window on the front of his house. He then drug him insde and called police saying the guy was robbing him and he shot in self defense as he was startled by the intruder.

Well we all know the early 70's and the racial problems, you Illinois guys might remember hearing of my hometown in news all the time for the racial strife, Cairo.

Anyway the shooter was white and the shootee was black.

It ended up that a nosey neighbor saw him drag the guy thru the window after he shot him and spoke up after the trial started.

If he would have left him where he laid he would have been fine, but by dragging him inside he screwed the pooch.
I think he served like 8 yrs for that.

As a person that has carried a weapon the last 18 years, in job performance and personal carry. The laws are pretty much cut and dry as to what, when, why you can shoot.

As for your scenario Goose........whats the old saying? You never shoot a fleeing felon?

But I think I am with you in your thought about that one. I'm thinking she probably got what she deserved, especially if she was a returning thief!

He owned a 50 acre fruit orchard in SE Ohio. It was mainly to keep kids (and grown ups) from stealing fruit that had been sprayed with DDT. And the occassional over zealous Jehovah's Witness crowd. He kept it by the front door.<img src=icon_smile_wink.gif border=0 align=middle>

My only rule of thumb here is
"If their beyond NO DOUBT RUNNING AWAY!, then you dont shoot.
If you shoot someone in the Back thats what makes it hard.

But What his statement was "He believed she was trying to RUN HIM OVER!" that is the over riding statement, Law enforcement would shoot in that case, so My question would be and for the Court,
"Did he have the right to defend his Land, knowing calling Law enforcement wouldnt be able to respond or arrive on time?"

Look at Myself, because of the District lines,I have a Address of the town 7 miles away, but I fall under a Towns FIRE DISTRICT/RESCUE thats 14 miles away and under the County/State law enforcement by 1/4 of a mile.
That was a pretty BIG WAKE-UP CALL.
