By PAULINE JELINEK, Associated Press Writer WASHINGTON - Saying American soldiers should not be used as "guinea pigs for experimental drugs," a federal judge Monday ordered the Pentagon (news - web sites) to stop mandatory anthrax vaccinations started in 1998. U.S. District Judge Emmet G. Sullivan said he was convinced by plaintiffs in a class action suit that the vaccine is experimental and being "used for an unapproved purpose" — that is, for exposure to airborne anthrax as well as exposure through the skin. Officials at the Defense Department and Food and Drug Administration (news - web sites) said they had not seen the ruling and had no immediate comment. But the federal government has long maintained that the licensed vaccine is safe, is not experimental and can be used for protection against anthrax inhaled or absorbed through the skin. More than 900,000 servicemen and women have received the shots, among the millions of doses of various vaccines administered annually to protect troops against disease and bioterror threats. Hundreds of service members have been punished or discharged for refusing them, according to the Pentagon. "The women and men of our armed forces put their lives on the line every day to preserve and safeguard the freedoms that all Americans cherish and enjoy," Sullivan said in Monday's 34-page ruling. "Absent an informed consent or presidential waiver, the United States cannot demand that members of the armed forces also serve as guinea pigs for experimental drugs," Sullivan said. In granting the preliminary injunction, Sullivan ordered the government to file responses by Jan. 30. Anthrax is a naturally occurring bacterium that typically affects sheep and cattle. When inhaled, dry anthrax spores can be deadly to humans. The federal government approved the vaccine three decades ago. But plaintiffs — unidentified active duty, National Guard and civilian defense employees — say the license was only for exposure through the skin, and that it may not be safe. Sullivan's ruling said the label on the vaccine does not specify which method of anthrax exposure it protects against. He cited a 1998 law prohibiting the use of new drugs or those unapproved for their intended use unless people being given the drug consent to its use or the president waives the consent requirement. Congress passed the law amid fears that the use of such drugs may have led to unexplained illnesses — which have come to be known as Gulf War Syndrome (news - web sites) — among veterans of the 1991 Persian Gulf War (news - web sites). The anthrax vaccine itself has been approved since the 1970s and used regularly to protect veterinarians and scientists working with anthrax. Believing Iraq (news - web sites) and other nations had produced anthrax weapons, former Secretary of Defense William Cohen in 1997 ordered the armed forces immunized. While the government does not recommend vaccinating the general public, it says the vaccine overall is very safe, with rare severe side effects such as dangerous allergic reactions. But hundreds of military personnel have refused the shots, worried they could be connected to complaints of chronic fatigue, memory loss and other problems. A leaflet inserted with the product, which originally stated that adverse reaction occurred in 0.2 percent of cases, was recently revised to reflect a rate between 5 percent and 35 percent, the ruling said. It said there have been at least six deaths linked to the vaccine. The 0.2 percent rate came from an earlier government report that there were only 105 serious reactions in over 830,000 recipients, the ruling said without giving details. The program was started to vaccinate all 2.4 million members of the active and reserve military, but was radically reduced after factory violations by the nation's sole vaccine manufacturer resulted in dwindling supplies. The FDA cleared Lansing, Mich.-based BioPort's manufacturing plant in January of 2002 to produce the vaccine and to resume shipments. After a three-month study considering the new domestic need, previous supply problems and other issues, the Pentagon decided to give the shots only to troops, essential civilians and contractors who are assigned for more than 15 days to "higher threat" areas of the world. Officials declined to identify those areas. Nor would they say how many troops would be given the vaccine. WE WERE TOLD STAND IN LINE,SIGN A "NON DISCLOSURE LETTER" SHUT UP ABOUT IT! THEY GAVE US BOTH ANTHRAX AND BOTCLISUM (?) NOW IF THEY LOOSE THEIR APPEAL THEY'LL HAVE TO GO BACK AND REPAIR ALL THOSE RECORDS AND CAREERS THEY LOSSED FOR REFUSING TO TAKE IT. NOW THIS IS STARTING TO GIVE SOME CERDIT TO THE "GULFWAR ILLINES" THE NGWRC "NATIONAL GULF WAR RESERCH CENTER"IS WORKING HARD TO MAKE SURE SWA VETS ARE GETTING THE SPECIAL BENEFITS AND RIGHTS TO CARE. I'M GETTING TO KNOW A MEMBER AND THEY IMPRESS ME ALOT ABOUT WHAT THEY DO AND HAVE DONE FOR GULFWAR VETS,THEN AND NOW. IT AINT GOING TO BE EASY PRESS TO TEST |

So does this mean I don't have to finish the whole shot rotation? Or that I don't HAVE to get it again. After the series is done? I just woke up so I'm still groggy. "If all the commercials say: 'An Army of One', why am I surrounded by the fools!?" |

There is a temporary injunction in effect. You do not have to get the shots, and if the DoD insists, you can file a complaint with the court that issued the ruling. Someone would be held in contempt. <img src="http://www.worldaffairsboard.com/sigs/snipersig.jpg " border=0> |

What I suspect is that the big problem is that they give the injections all at once, causing the immune system to freak. I wonder if staggering the injections over a few weeks or months wouldn't be a better idea resulting in fewer health hazards. Actually, they do stagger it. From what I understand, the 6 shots happen over a 3 month period. I for one am relieved. I was 3 months out from getting them, and I've heard too many scary stories about extra complications with women's reproductive system with these vaccines. I know you only hear about the one bad case in 1,000, but still... That being said, I'm not sure why it is they decided we were being "experimented" on. If this vaccine has been in use since the 70's, isn't the experimentation period over? And I don't think any of those people will necessarily be reinstated. An order is an order, even if later it is determined to be a bad one. The only way they would be reinstated is if they determine it was not a legal order, but I don't see how that would be. |

It will be on the individual to request one but I beleive if things stand as they are now a lot of Article 15's and Courts Martials will be expunged from individuals records. This could lead to reinstatement back into service with all pay and allowances as well as date of rank corrected as if you never left. THEY WERE USING A TYPE OF ANTHRAX SHOT FOR VETS AND PEACE CORP WORKERS GOING TO AFRICA,YOU ARE ONLY TALKING LIKE UNDER A 1000 AND THEY HAD TO GIVE CONSENT TO THE INJECTION. IN ORDER FOR IT NOT TO BE EXPERIMENTAL ANYMORE,THE MAKER OF THE DRUG HAS TO SUMMITT APPLCATION FOR USE. THIS IS WHEN THEY RELEASE TO THE FDA ALL PAPERS ON THE DRUG FROM,WHATS IN IT,TO ADVERSE SIDEEFFECTS TO HOW MANY DIED. THEN THE FDA DECIDES THE WAY THE SHOT WILL BE USED,OR NOT USED,OR MAKE A REQUIREMENT THAT THEY DISCLOSE ALL THE POSSIBLE HEALTH RISK THAT COULD HAPPEN,THEN GIVING THE PERSON THE CHOICE. IF THEY LEAVE IT EXPERIMANTAL THAN THIS HASNT BEEN DONE EXCEPT NOTIFING THE FDA OF THE USE OF THE SHOT FOR "TESTING" OR EXPERIMINTING. STATING NATIONAL SECURITY THEY DONT SUPPLY THE ADVERSE SIDE EFFECTS OF HEALTH PROBLEMS WITH IT,TO KEEP FROM HAVING LIABILITY. WHEN THEY GAVE THE FIRST ROUNDS OF ANTHRAX SHOTS TO A DEPLOYING GROUP IN 90, YOU SIGNED A LETTER,STATING YOU CAN NOT TALK ABOUT OR TELL ANYONE YOU RECVIED IT SAYING IT WAS "CLASSIFIED" ON YOUR SHOT RECORD THEY WROTE "1 VACC-A" AND FOR ANTHRAX AND "1 VACC -B FOR BOCULIUSM" WITHOUT ANYOTHER NOTES TO DETERMINE WHICH WAS WHICH OR WHAT THEY WERE. THE MILITAY OTHER BIG PROBLEM WHEN IT STARTED TO HAVE PROBLEMS WAS THAT SHOT RECORDS AND OTHER DOCUMENTS HAVE BEEN "LOST" OR DESTORYED BY ACCIDENT ON TROOPS DEPLOYED TO THE GULF REGION FROM THE EARLY 90'S SO THEY SAY THEY REALLY CANT GIVE A GOOD ACCOUNT OF SIDE EFFECTS,BUT THEIR SURE THEY WERE LOW AND NON LIFE THREATING. THE NGWRC IS WORKING ON THIS MATTER FOR YEARS, AND IT GETS UGLIER ALL THE TIME SO THATS WHY THEY STILL CALL THEM "EXPIERMENTAL DRUGS" PRESS TO TEST |

First hint it takes 6 vaccinations over 18 months or so. Former CJCS Admiral Crow was on the board of BioPort if not the CEO that produces this crap. They have had various quality control problems also. This is a good step for the DOD to actually admit it's experimental and won't do squat for the troops. While explaining that far too many troops had some really nasty reactions. Jack |

THE LITTLE DIRTY SECERT HERE NOW IS THE DOD IS TRYING TO DO A LEGAL MOVE IN WHICH ONLY THE 6 PLAINTIFFS LISTED ON THE DOCK-IT WILL BE PROTECTED. THE OTHER WAY AROUND THE WHOLE THING IS BY THE PRES. TO ISSUE A "PRES. ORDER" IN WHICH THE JUDGES RULING DONT AMOUNT TO A HILL OF BEANS.
