WOW!! 43 minutes and I'm a Hawg driver! <img src=newicons/anim_lol.gif border=0 align=middle> And I'd be leary of that DVD. Some of those "manuals" are copyrighted books.

Copy writed material once sold under a copywrite is fair game. It becomes puplic domain after the initial sale.

So what your telling me is if I purchase a newspaper/magazine and then resell that material that it's not copyright infringemnet?.... don't think so

Yes that is exactly what I am telling you, for written copyrighted material only.
Thats how a used book store works. If I sell you my collection of back issue Playboys for instance ( a periodical just like the newspaper/magazine you mentioned) I have not broken any copywrites. Otherwise a used book store could not exsist.
Now on the other hand intelecual property writes for say music and other forms of media is much different. If that "how to fly an A-10" DVD was not an original and was in fact an illeagal copy that someone printed off from their home computer that person who made it would be liable for $150,000 per infrigement while the buyer would be liable for stolen goods something like $1000. As long as the DVD or book was originally sold under copyright its public domain to be sold, barted, given, whatever. Only copying it and/or distributing copy of said work is copyright protected.

JMF, I see what your saying and I agree with you in that aspect. If you purchase an item, you have the right to sell that item as a whole, any time you see fit. This is simply selling your personal property.

However, the actual copyright to the material still belongs to the copyright holder (author, photographer, publisher), meaning you cannot reproduce, alter, or claim it as your own work.

On the other hand, items classified as “Public Domain” allow you to use the material in such a fashion. Case in point, the logo for my website has a photo of an A-10 that was taken for or by the military. I am allowed to utilize and alter this image without providing any payment to the original photographer because it is classified as public domain material.

Yes, your right Hitler. Now the question at hand. It was raised that buying a purchased copy of a book online though ebay may violate copyright, it doesn't. The book once bought IS public domain. The content is still under copyright, that was never in dispute but the book can be resold at "market" value; meaning that it (i.e. the book) can be sold for whatever someone is willing to pay as long as no one makes a "copy" of said work.

I guess what confuses me is that this guy has "copied" the books onto a DVD. Unless they were originally offered ia a dvd format, couldn't his copying them into a new format/media, for personal gain, be construed as infringement?

I guess it could if it were not originaly sold as that DVD. The add is pretty criptic. You could always ask the guy selling it if your interested.
